AN ACT concerning
Montgomery County - Housing Opportunities Commission
MC 248-81
FOR the purpose of finding and declaring a public emergency
in Montgomery County with respect to a critical
shortage of affordable rental accommodations resulting
from condominium conversions and rapidly rising
construction and operating costs; finding that the
problems thereby created are severe and frustrate a
balanced housing mix and provision of housing for all
economic segments of the community which are declared
to be public purposes under the housing opportunities
commission of Montgomery County; revising the meaning
of "persons of eligible income" and establishing
criteria for the determination thereof and making the
determination by the county executive conclusive of the
matter; providing for amendment of that determination
by certain procedures; revising the meaning of "housing
project for persons of eligible income" by defining the
term "substantial portion" used therein; revising the
presumption of validity of bonds issued by the housing
opportunities commission of Montgomery County to
conform to the provisions relating to "persons of
eligible income"; and making technical and stylistic
changes.
BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

(a) It is hereby found and declared that there exists
within Montgomery County a critical shortage of decent, safe
and sanitary dwelling accommodations available either to
