BY repealing and reenacting, without amendments,

Article 27 - Crimes and Punishments

Section 534-1

Annotated Code of Maryland

(1976 Replacement Volume and 1980 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 27 - Crimes and Punishments

534L.

(a) The provisions of this section apply to Baltimore
County [and], Baltimore City, FREDERICK COUNTY AND CARROLL
COUNTY.

(b) (1) It is unlawful on Sunday for any wholesale or
retail establishment to conduct business for labor or profit

in the usual manner and location or to operate its

establishment in any manner for the general public.

(2) A wholesale or retail establishment may not
cause, direct, or authorize any employee or agent to engage
in or conduct business on its behalf on Sunday.

(c) [1)] The State's Attorney [of Baltimore County]
may petition the Circuit Court to enjoin any violation of
this section.

[(2) The State's Attorney of Baltimore City may
petition the Circuit Court or Circuit Court No. 2 of the
Supreme Bench of Baltimore City to enjoin any violation of
this section.]

(d) (1) Any person, firm, or corporation violating the
provisions of this section is guilty of a misdemeanor and,
upon conviction, is subject to the penalties provided by
this subsection.

(2) The first conviction is punishable by a fine
not to exceed an amount equivalent to $500 multiplied by the
number of employees that are working in excess of the number
permitted under the provisions of § 534L-1 of this article.

(3) The second conviction is punishable by a
fine not to exceed an amount equivalent to $1,000 multiplied
by the number of employees that are working in excess of the
number permitted under the provisions of § 534L-1 of this
article.
