7-306. WAIVER OF EXAMINATION.
(A) IN GENERAL.
SUBJECT TO THE PROVISIONS OF THIS SECTION, THE BOARD
MAY WAIVE ANY APPROPRIATE EXAMINATION REQUIREMENT OF THIS
TITLE FOR AN APPLICANT WHO IS LICENSED OR REGISTERED TO
PRACTICE REGISTERED NURSING OR LICENSED PRACTICAL NURSING IN
ANY OTHER STATE OR COUNTRY.
(B) CONDITIONS.
THE BOARD MAY GRANT A WAIVER UNDER THIS SECTION ONLY IF
THE APPLICANT:
(1) PAYS THE APPLICATION FEE SET BY THE BOARD
UNDER § 7-303 OF THIS SUBTITLE; AND
(2) PROVIDES ADEQUATE EVIDENCE THAT:
(I) AT THE TIME THE APPLICANT GRADUATED
FROM A NURSING EDUCATION PROGRAM APPROVED IN THE OTHER STATE
OR COUNTRY, THE APPLICANT MET THE EDUCATIONAL QUALIFICATIONS
THEN REQUIRED BY THE LAWS OF THIS STATE; AND
(II) THE APPLICANT BECAME LICENSED OR
REGISTERED IN THE OTHER STATE OR COUNTRY AFTER PASSING IN
THAT OR ANY OTHER STATE OR COUNTRY AN EXAMINATION THAT IS
SIMILAR TO THE EXAMINATION FOR WHICH THE APPLICANT IS
SEEKING THE WAIVER.
REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 43, §§
295(c) and 296(d). Its revision is patterned
after the standard language used throughout this
title for provisions that allow or require waiver
of examination requirements.
Subsection (b)(2)(ii) of this section is new
language added to state expressly that which
presently is only implied in the law — i.e.,
that an applicant for an examination waiver under
this section must have passed an examination that
is similar to the examination for which the
applicant is seeking the waiver.
In subsection (b)(2)(ii) of this section, the
phrase "or any other state or country" is added
to conform to the current practice of the Board,
which provides expressly that a registered nurse
or licensed practical nurse who passed a
licensing examination in one state or country,
and who was then waived into a second state or
