under this title, then the applicant must pass
the examination before the applicant may be
licensed.
As to subsection (b) of this section, the present
requirements of this title concerning certified
nurse practitioners are retained even though they
are incomplete. The references to certified
nurse practitioners were added as a result of the
enactment of Ch. 564, Acts of 1979, whose primary
purpose was to provide for third party
reimbursement for services of nurse practitioners
who are certified by the Board. Since these
"miscellaneous" references may be misleading,
this issue is called to the attention of the
General Assembly.
Subsection (b)(3) of this section is new language
added in light of the power of the Board under §
7-205(3) and (4) of this title to adopt rules and
regulations that authorize, under certain
limitations, the performance of "additional acts"
by registered nurses.
Subsection (c)(2) of this section is new language
added to allow the Board to evaluate for initial
licensing the out-of-state training of an
applicant for a license to practice registered
nursing. This addition is called to the
attention of the General Assembly.
In subsection (d)(2)(ii) of this section, the
term "substantially" equivalent is added to
clarify that the Board has some discretion in
determining equivalence.
As to subsection (e) of this section, while there
is no express statutory mention that nurse
midwives have to take an examination to be
eligible for a license to practice midwifery,
nurse midwives must be certified by the American
College of Nurse Midwives, which certification
currently requires passing an examination.
The examination requirements for certified nurse
practitioners now appear in § 7-305 of this
subtitle.
