AN ACT concerning
Abandoned Property
FOR the purpose of creating new subtitles; defining certain
terms; requiring the Administrator of the Abandoned
Property Office to discover abandoned property of State
residents that is in the custody of the federal
government; requiring the Administrator to seek a
judicial determination of the State's right to custody
of abandoned property; authorizing a certain agreement
with the federal government for the return of certain
abandoned property; providing that the State shall pay
certain proportionate expenses; delineating
circumstances when a resident of this State shall be
presumed owner of certain abandoned property; providing
for indemnification of the federal government;
providing circumstances when the State consents to suit
and may use certain defenses; providing for
certification by the Governor of certain provisions in
a certain agreement; requiring notice; providing a
certain election for claims of abandoned property;
prohibiting certain claims against the State; making
certain provisions generally applicable; and generally
relating to abandoned property.
BY repealing and reenacting, with amendments,
Article - Commercial Law
Section 17-101 and 17-102, to be under the new subtitle
"Subtitle 1. Definitions; General Provisions";
and 17-105 through 17-128, inclusive, to be
under the new subtitle "Subtitle 3. Abandoned
Property in this State"; under the amended
title "Title 17. Disposition of Abandoned
Property"
