Section 467B to be under the new subheading "Recording

or Broadcasting Criminal Trials"
Annotated Code of Maryland
(1976 Replacement Volume and 1980 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 27 - Crimes and Punishments

RECORDING OR BROADCASTING CRIMINAL TRIALS

467B.

(A)  IN THIS SECTION, THE FOLLOWING WORDS HAVE THE
MEANINGS INDICATED.

(1)  "EXTENDED COVERAGE" MEANS ANY RECORDING OR
BROADCASTING OF PROCEEDINGS BY THE USE OF TELEVISION, RADIO,
PHOTOGRAPHIC, OR RECORDING EQUIPMENT.

(2)  "LOCAL ADMINISTRATIVE JUDGE" MEANS THE
COUNTY ADMINISTRATIVE JUDGE IN THE CIRCUIT COURT AND THE
DISTRICT ADMINISTRATIVE JUDGE IN THE DISTRICT COURT.

(3)  "PROCEEDING" MEANS ANY TRIAL, HEARING,
MOTION, ARGUMENT, OR OTHER MATTER HELD IN COURT OR BEFORE
THE GRAND JURY.

(B)  EXTENDED COVERAGE OF CRIMINAL PROCEEDINGS IN THE
TRIAL COURTS OF THIS STATE IS PROHIBITED.

(C)  NOTWITHSTANDING THE PROVISIONS OF SUBSECTION (B)
OF THIS SECTION, THE PROHIBITIONS OF THIS SECTION DO NOT
APPLY TO:

(1)  THE USE OF ELECTRONIC OR PHOTOGRAPHIC
EQUIPMENT APPROVED BY THE COURT FOR THE PERPETUATION OF A
COURT RECORD; AND

(2)  INVESTITURE OR CEREMONIAL PROCEEDINGS, IN
WHICH THE LOCAL ADMINISTRATIVE JUDGE MAY REGULATE THE
PRESENCE AND USE OF CAMERAS, RECORDERS, AND BROADCASTING
EQUIPMENT.

(D)  IF ANY PERSON VIOLATES THE PROVISIONS OF THIS
SECTION, THE COURT MAY HOLD THE PERSON IN CONTEMPT OF COURT.

(E) NOTHING IN THIS SECTION IS INTENDED TO RESTRICT
ANY EXISTING RIGHTS OF THE MEDIA TO REPORT PROCEEDINGS.
