REVISOR'S NOTE: Subsections (a) and (c) of this section
are new language derived without substantive
change from the first sentence, the first clause
of the fourth sentence, and the last clause of
the fifth sentence of Art. 43, § 294(d).

The present reference to the Board secretary also
being the "treasurer" is deleted as obsolete
since the Board secretary no longer acts as the
treasurer.

Subsection (b) of this section is standard
language added to this and, where necessary,
corresponding sections of other titles of this
article to clarify the manner of election for
officers of the Board.

The reference in the fourth sentence of present
Art. 43, § 294(d) to the list of licensees being
"open to public inspection ... for its
safekeeping" is deleted as needless repetition of
independent provisions of law in Art. 76A, §§ 1A
and 2 of the Code.

The first clause of the fifth sentence of present
Art. 43, § 294(d), which requires the Board
secretary to be bonded, is deleted as unnecessary
since, in fact, all State employees or officers
are covered by a blanket bond.

The references in present Art. 43, § 294(d) to
the duty of the Board secretary to keep a list of
each licensee under this title and to collect
funds are impractical for the Board secretary to
perform and contrary to the current practice of
the Board. Therefore, these provisions are
revised as duties of the Board under § 7-205 of
this subtitle.

7-204. QUORUM; MEETINGS; COMPENSATION; STAFF.

(A) QUORUM.

(1)  EXCEPT AS PROVIDED IN PARAGRAPH (2) OF THIS
SUBSECTION, A MAJORITY OF THE FULL AUTHORIZED MEMBERSHIP OF
THE BOARD THAT INCLUDES AT LEAST ONE OFFICER IS A QUORUM.

(2)  IN ADDITION TO THE REQUIREMENTS OF PARAGRAPH
(1) OF THIS SUBSECTION, ON A MATTER CONCERNING LICENSING OR
DISCIPLINING OF AN INDIVIDUAL, A QUORUM SHALL INCLUDE:

(I)  AT LEAST THREE REGISTERED NURSE
MEMBERS IF A REGISTERED NURSE OR AN APPLICANT FOR A LICENSE
AS A REGISTERED NURSE IS INVOLVED; OR

(II)  AT LEAST TWO LICENSED PRACTICAL NURSE
MEMBERS IF A LICENSED PRACTICAL NURSE OR AN APPLICANT FOR A
LICENSE AS A LICENSED PRACTICAL NURSE IS INVOLVED.
