Section 689C through 689E, inclusive, to be under the
new subtitle "Low-Level Nuclear Waste Disposal"
Annotated Code of Maryland

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:
Article 43 - Health
LOW-LEVEL NUCLEAR WASTE DISPOSAL

(A) IN THIS SUBTITLE, THE FOLLOWING TERMS HAVE THE
MEANINGS INDICATED.
(B) "HIGH-LEVEL NUCLEAR WASTE" MEANS:
(1) SPENT NUCLEAR REACTOR FUEL;
(2) LIQUID WASTE RESULTING FROM THE OPERATION OF
THE FIRST CYCLE SOLVENT EXTRACTION SYSTEM, OR ITS
EQUIVALENT, AND THE CONCENTRATED WASTE FROM SUBSEQUENT
EXTRACTION CYCLES, OR THEIR EQUIVALENT, IN A FACILITY FOR
REPROCESSING SPENT NUCLEAR REACTOR FUEL; OR
(3) SOLIDS INTO WHICH LIQUID WASTE, AS PROVIDED
IN PARAGRAPH (2) OF THIS SUBSECTION, HAS BEEN CONVERTED.
(C) "LOW LEVEL NUCLEAR WASTE" MEANS ALL RADIOACTIVE
WASTE THAT IS NOT CLASSIFIED AS HIGH LEVEL NUCLEAR WASTE,
TRANSURANIC WASTE, SPENT NUCLEAR FUEL, OR BYPRODUCT MATERIAL
AS DEFINED IN SECTION 11E.(2) OF THE UNITED STATES ATOMIC
ENERGY ACT OF 1954.
(C) "LOW-LEVEL NUCLEAR WASTES" MEANS WASTES CONTAINING
OR CONTAMINATED WITH RADIOACTIVE MATERIALS EMITTING
PRIMARILY BETA OR GAMMA RADIATION, NOT HIGH-LEVEL NUCLEAR
WASTES, AND WHICH ARE NOT TRANSURANIC WASTES.
(D) "TRANSURANIC WASTE" MEANS WASTE MATERIAL MEASURED
OR ASSUMED TO CONTAIN TEN NANOCURIES OR MORE OF TRANSURANIC
ACTIVITY PER GRAM OF WASTE.

(A) AFTER JANUARY 1, 1984, A PERSON MAY NOT ENGAGE IN
ANY ACTIVITY THAT PRODUCES OR GENERATES LOW LEVEL NUCLEAR
WASTE, AND THE SECRETARY MAY NOT REGISTER OR LICENSE ANY
PERSON UNDER § 689A OF THIS ARTICLE UNTIL THE SECRETARY
CERTIFIES (1) EXCEPT AS PROVIDED IN PARAGRAPH (2) OF THIS
SUBSECTION, THE DEPARTMENT MAY NOT ISSUE A LICENSE UNDER
