Section 3-7.1

Annotated Code of Maryland

(1978 Replacement Volume and 1980 Supplement)

(As enacted by Chapter ____ (H.B.__) of the Acts

of the General Assembly of 1981)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland

(as enacted by Chapter ____ (H.B.__) of the Acts of the

General Assembly of 1981) be repealed, amended, or enacted
to read as follows:

Article 67 - Washington Suburban Sanitary District

3-7.1.

(A) (1) IF THE COMMISSION DETERMINES AS PART OF A
GENERAL STORMWATER MANAGEMENT PROJECT THAT INCIDENTAL
FLOODPROOFING FOR SOME INDIVIDUAL PROPERTIES IS THE MOST
SOUND ALTERNATIVE FROM ECONOMICAL, ENVIRONMENTAL, AND
ENGINEERING POINTS OF VIEW TO CORRECT A PARTICULAR DRAINAGE
OR FLOODING PROBLEM, THE COMMISSION MAY EXPEND FUNDS' FOR
INDIVIDUAL FLOODPROOFING FACILITIES ON PRIVATE PROPERTY IN
THE PRINCE GEORGE'S COUNTY PORTION OF THE SANITARY DISTRICT
AND IN THAT PORTION OF THE CITY OF TAKOMA PARK IN MONTGOMERY
COUNTY.

(2) THE EXPENDITURE OF FUNDS UNDER THIS SECTION
MAY BE BY THE COMMISSION:

(I) REIMBURSING A PROPERTY OWNER FOR THE
COSTS OF CONSTRUCTION WORK; OR

(II) PERFORMING THE CONSTRUCTION WORK
UNDER CONTRACT AS PART OF THE GENERAL STORMWATER MANAGEMENT
PROJECT.

(B) (1) IF THE COMMISSION REIMBURSES A PROPERTY OWNER
FOR THE COSTS OF CONSTRUCTION WORK, THE PROPERTY OWNER SHALL
SUBMIT CONSTRUCTION PLANS AND A COST ESTIMATE TO THE
COMMISSION FOR REVIEW AND APPROVAL BEFORE CONSTRUCTION
COMMENCES.

(2) THE COMMISSION SHALL MAKE PAYMENT ONLY
AFTER:

(I)  THE COMMISSION INSPECTS AND APPROVES
THE COMPLETED FLOODPROOFING FACILITY; AND

(II)  THE PROPERTY OWNER SUBMITS THE
ORIGINAL COST INVOICE TO THE COMMISSION.
