6-508. PENALTIES.
A PERSON WHO VIOLATES ANY PROVISION OF THIS TITLE IS
GUILTY OF A MISDEMEANOR AND ON CONVICTION IS SUBJECT TO A
FINE NOT EXCEEDING $100 OR IMPRISONMENT NOT EXCEEDING 1 YEAR
OR BOTH.
REVISOR'S NOTE: This section is new language derived
without substantive change from the first
sentence of Art. 43, § 359(a) and from Art.43, §§
359(b) and 366A(f).
Present Art. 43, §§ 367A, 367B, and 367C were
enacted in 1976 as a separate subtitle entitled
"Cremation". Art. 43, § 367D was added to the
Cremation subtitle in 1977. Art. 43, § 367C of
the subtitle states that "{a}ny person who
violates any provision of this subtitle is guilty
of a misdemeanor and subject to a fine not
exceeding $1,000".
Present Art. 43, § 367A, which relates to
cremation records kept by licensees, now appears
as § 6-405 of this title and, therefore, is
subject to the penalties of present Art. 43, §
359(b) that are imposed under this section for
violation of any provision of this title. Thus,
the reorganization results in a new penalty under
this title for a violation of present Art. 43, §
367A. This change is called to the attention of
the General Assembly.
The second sentence of present Art. 43, § 360A
now appears as § 6-505 of this subtitle.
SUBTITLE 6. SHORT TITLE; TERMINATION OF TITLE.
6-601. SHORT TITLE.
THIS TITLE MAY BE CITED AS THE "MARYLAND MORTICIANS
ACT" .
REVISOR'S NOTE: This section is new language added to
conform to similar sections in other titles of
this article and to provide a convenient
reference to this title.
6-602. TERMINATION OF TITLE.
SUBJECT TO THE EVALUATION AND REESTABLISHMENT
PROVISIONS OF THE REGULATORY PROGRAMS EVALUATION ACT OF
1978, THIS TITLE AND ALL RULES AND REGULATIONS ADOPTED UNDER
THIS TITLE SHALL TERMINATE AND BE OF NO EFFECT AFTER JULY 1,
1982.
