6-503. USE OF NAME.

A LICENSEE MAY NOT PRACTICE MORTUARY SCIENCE UNDER ANY
NAME OTHER THAN:

(1)  THE NAME THAT APPEARS ON THAT PERSON'S
LICENSE; OR

(2)  THE NAME OF A PARTNERSHIP IN ACCORDANCE WITH
§ 6-401 OF THIS TITLE.

351(a), as that subsection relates to the use of
names.

6-504. PRE-NEED CONTRACTS.

A PERSON WHO IS NOT A LICENSED MORTICIAN MAY NOT OFFER
OR AGREE, DIRECTLY OR INDIRECTLY, TO PROVIDE SERVICES OR
MERCHANDISE UNDER A PRE-NEED CONTRACT.

REVISOR'S NOTE: This section is new language derived
without substantive change from the first clause
of Art. 43, § 366A(f).

The provision in present Art. 43, § 366A(f) that
refers to the making of pre-need contracts by
unauthorized persons as "practicing without a
license" is deleted as unnecessary and
misleading, as certain persons are exempted from
the provisions of § 6-501 of this subtitle, who
are not exempt from this prohibition concerning
the making of pre-need contracts. Therefore,
this prohibition is set forth affirmatively.

6-505. CREMATION CASKET.

A LICENSEE OR THE AGENT OF A LICENSEE MAY NOT REPRESENT
THAT A BURIAL OR FUNERAL CASKET IS REQUIRED FOR CREMATION.
