certain term; requiring physicians to make a certain
report concerning cancer and malignant diseases to
certain deputy health officers; requiring deputy health
officers to periodically forward physicians' reports to
the Secretary; requiring the Secretary to conduct
investigations into the cause, mortality, treatment,
prevention and cure of cancer or other malignant
diseases.

FOR the purpose of altering the method of filing reports
relating to cancer and other malignant diseases;
imposing certain duties on physicians and health
officers when they are notified of cases of cancer and
other malignant diseases? defining a term; authorizing
certain investigations; and generally relating to the
cancer and malignant disease registry.

BY repealing and reenacting, with amendments,

Section 133A

Annotated Code of Maryland

(1980 Replacement Volume and 1980 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 43 - Health

133A.

(a) In this subtitle, the following words have the
meanings indicated.

(1)  "Department" means the Department of Health
and Mental Hygiene.

(2)  "Secretary" means the Secretary of Health
and Mental Hygiene.

(3)  "Laboratory" means any public, private,
hospital, or institutional laboratory.

(4)  "PHYSICIAN" MEANS A PHYSICIAN LICENSED IN
THIS STATE UNDER TITLE 14 OF THE HEALTH OCCUPATIONS ARTICLE
OF THE CODE.

(b)   (1) The individual in charge of laboratory shall

report to the Department every positive tissue based

diagnosis of cancer OR OTHER MALIGNANT DISEASES derived from

a human body. Any physician submitting tissue to a

laboratory for diagnosis shall provide all information

necessary to allow the individual in charge of the

laboratory to comply with the provisions of this section.
