SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 43 - Health

42.

(a) [(7) The Department of Health and Mental Hygiene
may establish the form and method of application for
reimbursement under this section. [However, the Department
of Health and Mental Hygiene may not reimburse providers
participating in the Maryland medical assistance program for
items that are currently determined to be ineffective by the
United States Food and Drug Administration.]

[(c) However, the Maryland pharmacy assistance program
may not reimburse providers for items that are currently
determined to be ineffective by the United States Food and
Drug Administration.]

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1981.

AN ACT concerning

Developmentally Disabled Persons - Respite

Care

FOR the purpose of requiring the Department of Human
Resources to develop and implement respite care
services programs; defining certain terms; requiring
the promulgation of rules and regulations to include
certain requirements and provisions; and generally
relating to respite care services programs for
individuals who are developmentally disabled.

BY adding to

Article 88A - Social Services Administration

Section 128 and 129 to be under the new subtitle

"Respite Care for Developmentally Disabled

Persons"
