renewed, the Board verifies that the apprentice
actively is pursuing training. This prevents the
formation of a class of permanent "assistant
morticians" — a class of practitioners that is
not authorized by law. For this reason also, new
language is added to subsection (e)(2) of this
section to allow an apprentice to hold an
apprentice license only for the customary 4
years, but allow renewal beyond that time in the
Board's discretion if an apprentice needs more
time to complete the required training. The
revision is called to the attention of the
General Assembly.
Present Art. 43, § 362(d)(2) is deleted as
unnecessary in light of subsection (d)(1) of this
section.
6-314. REINSTATEMENT OF EXPIRED LICENSES.
THE BOARD SHALL REINSTATE THE LICENSE OF AN INDIVIDUAL
WHO HAS FAILED TO RENEW A MORTICIAN LICENSE FOR ANY REASON
IF THE INDIVIDUAL:
(1) REQUESTS THAT THE BOARD REINSTATE THE
LICENSE;
(2) MEETS THE APPROPRIATE RENEWAL REQUIREMENTS
OF THIS SUBTITLE;
(3) PAYS TO THE BOARD THE CURRENT RENEWAL FEE
REQUIRED BY THIS SUBTITLE; AND
(4) SUBMITS TO THE BOARD AN AFFIDAVIT STATING
THAT THE INDIVIDUAL DID NOT PRACTICE MORTUARY SCIENCE IN
THIS STATE WHILE THE LICENSE WAS EXPIRED.
REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 43, § 349.
Item (2) of this section is standard language
added to state expressly what presently is only
implied in the law -- that a person must be
eligible for renewal.
It is called to the attention of the General
Assembly that this section applies only to a
holder of a mortician license.
5-315. DENIALS, REPRIMANDS, SUSPENSIONS, AND REVOCATIONS.
(A) IN GENERAL.
SUBJECT TO THE HEARING PROVISIONS OF § 6-316 OF THIS
SUBTITLE AND EXCEPT AS TO A FUNERAL ESTABLISHMENT LICENSE,
THE BOARD MAY DENY A LICENSE TO ANY APPLICANT, REPRIMAND ANY
LICENSEE, OR SUSPEND OR REVOKE ANY LICENSE IF THE APPLICANT
OR LICENSEE:
