SECTION 2. AND BE IT FURTHER ENACTED, That subject to
the other provisions of the Health Occupations Article, the
licensing function of the Secretary regarding midwives under
Chapter 582, Acts of 1978 is transferred to the State Board
of Examiners of Nurses as of the effective date of this Act.
SECTION 3. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1981.

AN ACT concerning
Property Tax Credits Program - Eligibility
FOR the purpose of redefining the term "Homeowner" in the
property tax credits program so that a property owner
who permits, pursuant to a court order or separation
agreement, a member or certain members of the immediate
family to reside rent free in a dwelling may be
eligible for the credit even if the owner does not
reside in the dwelling.
BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:
Article 81 - Revenue and Taxes
12F-1.
(a) (7) "Homeowner" means every person who by July 1
of the taxable year in which the credit is to be allowed,
actually resides in, OR PERMITS, PURSUANT TO A COURT ORDER
OR SEPARATION AGREEMENT, A MEMBER OR MEMBERS SPOUSE, FORMER
SPOUSE, OR CHILDREN OF THAT PERSON'S FAMILY TO RESIDE
WITHOUT PAYMENT OF RENT, a dwelling in which the person has
a legal interest. Legal interest includes a purchase
pursuant to a land installment contract, as defined by §
10-101(b) of the Real Property Article, and any life estate,
whether as sole owner, joint tenant, tenant in common,
