HARRY HUGHES, Governor

237

REVISOR'S NOTE: This section is new language derived in
part from Art. 43, § 340(b)(2)(v), § 346 —
except the first clause of that section — and §
347(a).

Subsection (a) of this section is standard
language added to this and, where necessary,
corresponding sections of other titles of this
article, as discussed in the General Revisor's
Note to this article.

Also as to subsection (a) of this section, new
language that relates to apprentices is added to
clarify the sequence that occurs from training
through apprenticeship to licensing. Also as to
apprentices, see §§ 6-302 and 6-306 of this
subtitle.

Subsection (c) of this section is standard
language added to conform with present, similar
provisions in Art. 43 that govern examination for
licensing by other health occupation boards. It
provides an element of fundamental fairness by
requiring the Board to give qualified applicants
notice before the administration of examinations.

Subsection (d)(4) of this section is derived in
part from the last clause of the fourth sentence
of Art. 43, § 347(a), which provides that the
Board may include on an examination other
subjects that it considers necessary and proper.
In addition, standard language is added to this
and, where necessary, corresponding sections of
other titles of this article to state expressly
provisions that presently are only implied in the
law: i.e., that — as long as the examination
complies with requirements of this section — the
Board has control over the form and scoring of
the required examination.

In subsection (d)(1) of this section, the terms
"contagious" and "communicable" are deleted as
unnecessary in light of the use of the term
"infectious".

In subsection (d) of this section, the reference
in present Art. 43, § 347(a) that requires the
Board to examine an applicant concerning "the
proper sanitation and disinfection of persons
dying from infectious or contagious diseases", is
deleted as archaic and, in any event, unnecessary
in light of the broader provisions of this
subsection.

As to subsection (d)(2)(ii) of this section, new
language is added to clarify that the practical
part of the examination is given in the presence
