[ (3) ] (5) (6) If a municipality does not have a
local health department, the Department also shall require
as a condition to the issuance of a permit that a permit
holder shall provide access to the facility by any
authorized official, agent, or employee of an agency
designated by the mayor of the municipality, for the
purposes set forth under subsection (k)(2) of this section.

(1) (1) Except for designated hazardous substances OR
LOW-LEVEL NUCLEAR WASTE used for residential purposes or
those regulated by the Department of Agriculture, a person
may not transport a designated hazardous substance OR
LOW-LEVEL NUCLEAR WASTE from a source within the State or to
a facility within the State unless the person first obtains
a certificate from the Department of Health and Mental
Hygiene and the transporting vehicle is certified by the
Department of Health and Mental Hygiene.

(2) Every person holding a hauler certificate

[(1)] (I) Report periodically, on a form
prescribed by the Department of Health and Mental Hygiene,
on the source, disposal destination, volume, and nature of
the designated hazardous substance OR LOW-LEVEL NUCLEAR
WASTE transported;

[(2)] (II) Secure a bond for the purpose of
indemnifying the State for abatement of pollution resulting
from the improper transportation of designated hazardous
substances OR LOW-LEVEL NUCLEAR WASTE;

[(3)] (III) Pay a yearly fee for a transporting
vehicle certification not to exceed $50.00;

[(4)] (IV) During transportation, carry within
the vehicle cab the manifest, carry prominently displayed or
affixed to the outside of the left door of the vehicle cab
the vehicle certificate, and carry only properly labeled and
secure containers of designated hazardous substances OR
LOW-LEVEL NUCLEAR WASTE;

[(5)] (V) Stop the vehicle upon request of any
police officer, display all required documentation, and
allow inspection, investigation, and sampling for actual or
potential violations of a certificate or of applicable State
or federal law; and

[(6)] (VI) Remove from the transporting vehicle,
treat, blend, or mix, or store for any period of time,
designated hazardous substances OR LOW-LEVEL NUCLEAR WASTE,
only in a facility, except under Department supervision
during an emergency.

(3) THE DEPARTMENT MAY NOT ISSUE A CERTIFICATE
FOR THE HAULING OF LOW-LEVEL NUCLEAR WASTE UNLESS:
