SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1981.

AN ACT concerning

Airport Noise Zones Zoning - Variances

FOR the purpose of requiring the Board of Airport Zoning
Appeals to grant specific variances under certain
circumstances consider and formally respond to certain
testimony and evidence when reviewing requests for
variances under airport zoning regulations or airport
noise zone regulations; prohibiting the State Aviation
Administration from granting a certain permit if a
proposed action in a certain noise zone would violate
local land use and zoning laws; requiring the Board of
Airport Zoning Appeals to grant variances under certain
circumstances; and permitting an affected political
subdivision, upon timely application, to intervene in
certain appeals.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

5-507.

(a) In a case of practical difficulty or unnecessary
hardship, the Board, after public notice and hearing, may
grant a specific variance from the airport zoning
regulations adopted under this subtitle.
