establishment". Since license is defined in
subsection (f) of this section, "licensee" need
not be defined separately.
(J) LICENSED MORTICIAN.
"LICENSED MORTICIAN" MEANS, UNLESS THE CONTEXT REQUIRES
OTHERWISE, A MORTICIAN WHO IS LICENSED BY THE BOARD UNDER
THIS TITLE TO PRACTICE MORTUARY SCIENCE.
REVISOR'S NOTE: This subsection is new language added
to avoid needless repetition of phrases such as
"individual licensed to practice mortuary
science".
On occasion the term "licensee" is used in this
title as a synonym for "licensed mortician".
Since "license" is defined in subsection (f) of
this section, "licensee" need not be defined
separately.
(K) MORTICIAN.
"MORTICIAN" MEANS AN INDIVIDUAL WHO PRACTICES MORTUARY
SCIENCE.
REVISOR'S NOTE: This subsection is new language added
to provide an express definition of "mortician".
It is stated in the standard form used to define
the various health practitioners regulated under
this article.
In this subsection and throughout this title,
"mortician" is substituted for the present terms
"funeral director and embalmer" for brevity and
to reflect the fact that, with the exception of
the limited number of funeral director licenses,
a single license presently encompasses what
previously were two separate occupations and
licenses.
The transition to a unified license that was
mandated by uncodified Section 3 of Ch. 129, Acts
of 1962, was to have been completed by May of
1963. However, the Board issued the new unified
license to some practitioners, but continued to
issue funeral director licenses to other
practitioners. To clarify the situation, Ch.
330, Acts of 1980, reenacted present Art. 43, §
359(a), which prohibits the practice of the
unified occupation without a license, and also
permitted holders of certain funeral director
licenses to renew those licenses.
(L) PRACTICE FUNERAL DIRECTION.
