AN ACT concerning

Insurance Commissioner - Surplus Line
Affidavits and Premium Receipts Taxes

FOR the purpose of changing the time limit for filing
surplus line affidavits and paying premium receipts
taxes.

BY repealing and reenacting, with amendments,

Article 48A - Insurance Code

Section 185 and 194(b)

Annotated Code of Maryland

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 48A - Insurance Code

At the time of placing any such insurance an affidavit
setting forth the facts referred to in § 184, and such other
facts as the Commissioner may require, must be personally
executed by the surplus line broker or by the originating
agent or broker. [Such affidavit shall be filed with the
Commissioner within thirty (30) days after the insurance is
placed.] SUCH AFFIDAVIT SHALL BE FILED WITH THE
COMMISSIONER ON OR BEFORE THE 45TH DAY AFTER THE LAST DAY OF
THE MONTH IN WHICH THE BUSINESS WAS PROCURED INSURANCE WAS
PLACED.

(b) The surplus lines broker shall pay the taxes under
subsection (a) to the Commissioner on a monthly basis; [and
shall on or before the 15th day of each month forward to the
Commissioner the amount of premium receipts taxes due upon
business done during the preceding month] ON OR BEFORE THE
