individual otherwise is entitled to be licensed,
the applicant may take the examination in this
State. The present law is ambiguous, but it
appears that an applicant who receives training
out-of-state and seeks to be licensed in this
State first may have to become licensed in
another state and then waive into this State
under present Art. 43, § 555B-17, which does
allow the Board to evaluate an individual's
out-of-state training. Subsection (d)(2) of this
section states expressly that the Board may
evaluate the out-of-state training of an
applicant without the necessity of an
intermediate license from another state. This
addition is called to the attention of the
General Assembly.

Subsection (d)(1) of this section is revised to
clarify that an electrology education program
that is approved under this title need not be
taught at an approved institution of higher
learning. This substitution is called to the
attention of the General Assembly. As to the
approval of an electrology education program, see
§§ 5-401 and 5-402 of this title.

Subsection (e) of this section is rephrased in
standard language to state expressly that if a
license applicant is required to take an
examination under this subtitle, then the
applicant must pass that examination before the
applicant may be licensed.

For the definition of "physician", see § 1-101 of
this article.

5-303. APPLICATIONS FOR LICENSES.

TO APPLY FOR A LICENSE, AN APPLICANT SHALL:

(1)  SUBMIT TO THE BOARD AN APPLICATION ON THE
FORM THAT THE BOARD REQUIRES;

(2)  SUBMIT TO THE BOARD EVIDENCE OF COMPLIANCE
WITH THE REQUIREMENTS OF § 5-302 OF THIS SUBTITLE; AND

(3)  PAY TO THE BOARD AN EXAMINATION FEE OF 3100.
