SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:
Article 2B - Alcoholic Beverages
92.
In Anne Arundel County, notwithstanding any other
provisions in this subtitle, the following restrictions,
limitations and regulations shall be in effect:
(b) (1) Licensed premises may not remain open to the
public or to private persons or parties for any purpose for
more than 15 minutes after the hours and days for sales set
forth in this section, even though no sales are made after
the hours of closing.
(2) However, [upon application of any licensee
holding a Class B license, or a special hotel-motel
restaurant complex license, as set out in § 28 (i)] license
commissioners may permit [the licensee] CERTAIN LICENSEES to
[serve] SELL food OR OTHER NONALCOHOLIC ITEMS until a
specified hour, if:
(I) [the] THE licensee proves to the
satisfaction of the board of license commissioners that
suitable precautions have been taken to prevent the sale or
consumption of alcoholic beverages on the licensed premises
after the hours of closing[.]; AND (II) THE APPLICANT
LICENSEE HOLDS:
1. A CLASS B LICENSE;
2. A SPECIAL HOTEL-MOTEL RESTAURANT
COMPLEX LICENSE, AS SET OUT IN § 28(I); OR
3. A CLASS A LICENSE AND HAS RETAIL
SALES OF ALCOHOLIC BEVERAGES WHICH DO NOT EXCEED 25 PERCENT
OF THE LICENSEE'S TOTAL RETAIL VOLUME.; OR
4. A CLASS H LICENSE.
(3) Permission shall be evidenced by a suitable
license authorized by the board of license commissioners and
issued by the clerk of the circuit court.
(4) The annual fee is $10.
