Maryland-National Capital Park and Planning Commission
(Police Powers of Municipalities)

FOR the purpose of removing restrictions on the police power
of municipalities in certain areas under the
jurisdiction of the Maryland-National Capital Park and
Planning Commission; and clarifying language.

BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 66D - Maryland-National Capital Park
and Planning Commission

5-108.

[Nothing in this] THIS article [shall be deemed to]
DOES NOT limit or restrict the police power of the State [of
Maryland or of the counties], EITHER COUNTY, OR ANY
MUNICIPALITY in which any park, parkway, forest, street,
road, boulevard, or other public way, ground, or space is
located, EXCEPT THAT SUCH CONCURRENT POLICE POWER OF A
MUNICIPALITY SHALL EXTEND ONLY TO AREAS LOCATED WITHIN ITS
BOUNDARIES FOR PURPOSES OF THIS ARTICLE.
