Ch. 447

(2)  [After it receives a request for review, the
State Board shall appoint a hearing board of at least three
individuals who are knowledgeable in the fields and areas

significant to the educational review of the child] THE
STATE BOARD SHALL MAINTAIN A LIST OF AT LEAST 30 HEARING
OFFICERS INCLUDING, AS FAR AS PRACTICAL, EXPERTS IN ALL
AREAS OF HANDICAPPING CONDITIONS WHO ARE KNOWLEDGEABLE
REGARDING THE EDUCATION OF HANDICAPPED CHILDREN.

(3)  An individual may not serve as a hearing
board member if he:

(i) Is an employee of the State Board or
of any county board; or

(ii) Has an interest that would conflict
with his objectivity in the hearing.

(4)  TRAINING AND EXPERIENCE GAINED, INCLUDING
AREAS OF EXPERTISE, SHALL BE SUMMARIZED BY EACH HEARING
OFFICER LISTED AND MADE AVAILABLE TO PUBLIC SCRUTINY.

(5)  TO CHOOSE THE PANEL FOR ANY STATE LEVEL
HEARING, THE BOARD SHALL PROVIDE PARENTS WITH FOUR NAMES
SHALL BE SELECTED IN THE FOLLOWING MANNER:

(I) IN A ROTATING ALPHABETICAL SEQUENCE
FROM A LIST OF HEARING OFFICERS EXPERT IN THE AREA THE

PARENTS DECLARE TO REPRESENT THE CHILD'S HANDICAPPING

CONDITION, IF THE PARENTS REQUEST AN EXPERT; OR

(II) IN A ROTATING ALPHABETICAL SEQUENCE
FROM A LIST OF OTHER HEARING OFFICERS, IF THE PARENTS DO NOT
REQUEST AN EXPERT OR THERE ARE NOT ENOUGH EXPERTS LISTED.

(6) IF HEARING OFFICERS CHOSEN BY A METHOD IN
PARAGRAPH (5) OF THIS SUBSECTION ARE NOT AVAILABLE WITHIN
THE TIME REQUIRED, THE PARENTS SHALL CHOOSE THREE OF FOUR
NAMES, SELECTED BY THE BOARD BY THE ROTATING ALPHABETICAL
SEQUENTIAL METHOD.

(I)  THE BOARD SHALL PROVIDE THE PARENTS
WITH FOUR NAMES, WHICH, UNLESS OTHERWISE AGREED UPON BY BOTH
PARTIES, SHALL BE CHOSEN IN ROTATING ALPHABETICAL SEQUENCE
FROM THE LIST OF HEARING OFFICERS; AND

(II)  THE PARENTS SHALL CHOOSE THREE OF THE

FOUR .; AND

(III)  THE PARENTS SHALL NOTIFY THE BOARD
OF THEIR SELECTION WITHIN 15 DAYS OF THE BOARD'S
NOTIFICATION. IN THE ABSENCE OF SUCH NOTIFICATION BY
PARENTS, THE BOARD SHALL ASSIGN HEARING OFFICERS IN ROTATING
ALPHABETICAL SEQUENCE STARTING WITH THE LIST IN SUBPARAGRAPH
(I) ABOVE.
