AN ACT concerning
County Commissioners -
Filing and Publication Requirements
FOR the purpose of providing that only certain acts,
ordinances and resolutions adopted by County
Commissioners are required to be filed with the clerk
of the court of the county, providing that a fair
summary of such acts, ordinances and resolutions be
published in a newspaper of general circulation in the
county, that any county subject to Article 25 may
provide the procedure in Section 4 for the adoption of
acts, ordinances and resolutions on matters other than
contained in Section 3 of Article 25; and repealing the
provision concerning the Maryland Industrial
Development Financing Authority Act in Frederick
County.
FOR the purpose of broadening the application of deleting a
certain exception to the filing and publication
requirements for acts, ordinances, and resolutions
adopted and passed by a Board of County Commissioners.
BY repealing and reenacting, with amendments,
Article 25 - County Commissioners
Section 4(b)
Annotated Code of Maryland
(1981 Replacement Volume)
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:
Article 25 - County Commissioners
4.
(b) [(i)] An act, ordinance, or resolution adopted
or passed by the County Commissioners PURSUANT TO SECTION 3
OF THIS ARTICLE may not become effective until a copy
thereof has been filed with the clerk of the court of the
county, and a fair summary of the act, ordinance, or
resolution has been published, after adoption or passage, in
at least one newspaper of general circulation in the county.
Any act, ordinance, or resolution filed as herein required,
shall be admissible as evidence in any court proceeding upon
certification by the said clerk of the court. THIS
SUBSECTION DOES NOT PRECLUDE ANY BOARD OF COUNTY
COMMISSIONERS SUBJECT TO THIS ARTICLE FROM FOLLOWING THE
PROCEDURE PROVIDED IN THIS SUBSECTION FOR THE ADOPTION OF
ANY ACT, ORDINANCE, OR RESOLUTION CONCERNING MATTERS OTHER
THAN THOSE CONTAINED IN SECTION 3 OF THIS ARTICLE.
