SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:
Article 27 - Crimes and Punishments
10A.
(A) It shall be unlawful for any person or persons to
burn or cause to be burned any cross or other religious
symbol upon any private or public property within this State
without the express consent of the owner of such property
and without first giving notice to the fire department which
services the area in which such burning is to take place.
Any person or persons who violates the provisions of this
section shall, upon conviction, be deemed guilty of a
misdemeanor FELONY and shall suffer punishment [by
imprisonment in the county or Baltimore City jail] for a
period not to exceed 1-year 3 YEARS or shall be fined an
amount not to exceed $2,000 $5,000 or shall suffer both such
fine and imprisonment in the discretion of the court.
(B) IF A PERSON PREVIOUSLY CONVICTED OF VIOLATING THE
PROVISIONS OF SUBSECTION (A) OF THIS SECTION IS SUBSEQUENTLY
CONVICTED FOR VIOLATING THE PROVISIONS OF THIS SECTION, THE
PERSON IS GUILTY OF A FELONY AND PUNISHABLE BY IMPRISONMENT
FOR A PERIOD NOT EXCEEDING 3 YEARS OR A FINE OF NOT EXCEEDING
$5,000, OR BOTH.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1981.

FOR the purpose of providing that awards for medical
treatment, services, and appliances, and funeral
expenses may be made under the Criminal Injuries
Compensation Act; and making this Act an emergency
measure.
