SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section(s) 21-101(k) through (s),
respectively, of Article - Transportation, of the Annotated
Code of Maryland be renumbered to be Section(s) 21-101(1)
through (t) 21-101(m) through (u), respectively.

SECTION 2. AND BE IT FURTHER ENACTED, That section(s)
of the Annotated Code of Maryland be repealed, amended, or
enacted to read as follows:

Article - Transportation

21-101.

[(j) "Public bicycle area" means any highway, bicycle
path, or other facility or area maintained by this State, a
political subdivision of this State, or any of their
agencies for the use of bicycles.]

[(j-1) "Bikeway" means any trail, path, sidewalk, part
of the roadway or shoulder, or any other travelway so
designated by signing, or signing and marking for the use of
bicycles. A bikeway includes a bike lane.]

[(j-2) "Bike lane" means a portion of a roadway which
has been designated for preferential or exclusive use by
bicycles. It is distinguished from the portion of the
roadway for motor vehicular traffic by a paint stripe, curb
or other similar device.]

[(j-3) "Shoulder" means that portion of a highway
contiguous with the roadway for the accommodation of stopped
vehicles, for emergency use, and for the lateral support of
the base and surface courses of the roadway.]

(J) "BIKEWAY" MEANS ANY TRAIL, PATH, PART OF A

HIGHWAY, SIDEWALK, OR ANY OTHER TRAVELWAY SPECIFICALLY
SIGNED, MARKED, OR OTHERWISE DESIGNATED FOR BICYCLE TRAVEL.

(J-1) "BICYCLE PATH (CLASS I BIKEWAY)" MEANS ANY
TRAVELWAY DESIGNED AND DESIGNATED BY SIGNING OR SIGNING AND
MARKING FOR BICYCLE USE, LOCATED WITHIN ITS OWN RIGHT OF WAY
OR IN A SHARED RIGHT-OF-WAY AND PHYSICALLY SEPARATED FROM
MOTOR VEHICLE TRAFFIC BY BERM, SHOULDER, CURB, OR OTHER
SIMILAR DEVICE.

(J-2) "BICYCLE LANE (CLASS II BIKEWAY)" MEANS ANY
PORTION OF A ROADWAY DESIGNATED FOR SINGLE DIRECTIONAL
BICYCLE FLOW, AND LOCATED ADJACENT TO AND CONTIGUOUS WITH
THE ROADWAY.

(J-3) "BIKE ROUTE (CLASS III BIKEWAY)" MEANS A

RIGHT-OF-WAY DESIGNATED BY SIGNS OR PERMANENT MARKINGS AND
SHARED WITH PEDESTRIANS OR MOTORISTS.
