(h) (1) Every business entity, including an
individual, upon submitting a bid or otherwise applying for
a contract with the State, or any county or other
subdivision of the State, shall submit OR SHALL HAVE
SUBMITTED TO THE PROCURING AGENCY WITHIN THE PRECEDING 12
MONTHS an affidavit stating, to its best knowledge, whether
it or [(1)] any of its officers, directors, or partners, or
[(2)] any of its employees WHO ARE directly involved in
obtaining contracts with the State, or WITH any county or
other subdivision of the State, has been convicted of
bribery, attempted bribery, or conspiracy to bribe under the
laws of any state or OF THE federal government.
(2) IF AFTER SUBMITTING AN AFFIDAVIT TO A
PROCURING AGENCY AS REQUIRED BY PARAGRAPH (1) OF THIS
SUBSECTION, A BUSINESS ENTITY BECOMES AWARE THAT THE
STATEMENTS MADE IN THE AFFIDAVIT WERE NOT ACCURATE OR THAT
THE STATEMENTS ARE NO LONGER ACCURATE, BEFORE THE BUSINESS
ENTITY MAY ENTER INTO ANY CONTRACT WITH THE AGENCY, IT SHALL
SUBMIT TO THE AGENCY AN AFFIDAVIT SPECIFYING THE RELEVANT
CORRECTIONS OR MODIFICATIONS OF THE STATEMENTS MADE IN ITS
PREVIOUS AFFIDAVIT.
(2) THE REQUIREMENTS OF THIS SUBSECTION SHALL BE
SATISFIED IF THE AFFIDAVIT:
(I) INCORPORATES BY REFERENCE THE
STATEMENTS CONTAINED IN AN AFFIDAVIT FILED WITH THE SAME
PROCUREMENT AGENCY WITHIN THE PREVIOUS 12 MONTHS PURSUANT TO
THE REQUIREMENTS OF THIS SECTION; AND
(II) STATES THAT THOSE STATEMENTS REMAIN
ACCURATE.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1981.
