(B) IN THIS SECTION THE FOLLOWING WORDS HAVE THE
MEANINGS INDICATED:
(1) "ANNUAL INCOME" MEANS THE TOTAL INCOME FROM
ALL SOURCES, OF A FAMILY DESIGNATED IN THIS SECTION, FOR THE
INCOME TAX YEAR IMMEDIATELY PRECEDING THE YEAR IN WHICH THE
RENTAL UNIT IS SCHEDULED FOR CONVERSION TO A CONDOMINIUM,
WHETHER OR NOT INCLUDED IN THE DEFINITION OF GROSS INCOME
FOR FEDERAL OR STATE TAX PURPOSES. FOR PURPOSES OF THIS
SECTION, THE INCLUSIONS AND EXCLUSIONS FROM ANNUAL INCOME
ARE THE SAME AS THOSE LISTED IN ARTICLE 81, § 12F-1(6),
"GROSS INCOME" AS THAT TERM IS DEFINED FOR THE PROPERTY TAX
CREDITS FOR HOMEOWNERS BY REASON OF INCOME AND AGE.
(2) "DESIGNATED FAMILY" INCLUDES ANY OF THE
FOLLOWING HOUSEHOLDS:
(I) A HOUSEHOLD HEADED BY WHICH INCLUDES A
SENIOR CITIZEN; OR
(II) A HOUSEHOLD WHICH INCLUDES A
HANDICAPPED CITIZEN.; PROVIDED THAT
(III) THE SENIOR CITIZEN OR THE
HANDICAPPED CITIZEN HAS BEEN A MEMBER OF THE HOUSEHOLD FOR A
PERIOD OF AT LEAST 12 MONTHS PRECEDING THE NOTICE REQUIRED
IN § 11-102.1.
(3) "HANDICAPPED CITIZEN" MEANS A PERSON WITH A
MEASURABLE LIMITATION OF MOBILITY DUE TO CONGENITAL DEFECT,
DISEASE, OR TRAUMA.
(4) "SENIOR CITIZEN" MEANS A PERSON WHO IS AT
LEAST 65 62 YEARS OLD ON THE DATE THAT THE UNIT OWNER GIVES
NOTICE AS REQUIRED IN SECTION 11-102.1 OF THIS SUBTITLE.
(C) A DEVELOPER MAY NOT SELL A UNIT LEASED BY A
DESIGNATED FAMILY WITHOUT OFFERING TO THAT FAMILY A LEASE
EXTENSION FOR A PERIOD OF AT LEAST 3 YEARS FROM THE DATE OF
THE ISSUANCE OF THE NOTICE OF INTENTION TO CREATE A
CONDOMINIUM, IF THE FAMILY MEETS THE FOLLOWING CRITERIA:
(1) HAS LEASED THE UNIT FOR AT LEAST 2 YEARS;
(2) HAS AN ANNUAL INCOME WHICH DOES NOT EXCEED
80 PERCENT OF THE MEDIAN INCOME FOR THE AREA;
(1) HAS AN ANNUAL INCOME WHICH DOES NOT EXCEED
80 PERCENT OF THE MEDIAN INCOME FOR THE STANDARD
METROPOLITAN STATISTICAL AREA IN WHICH THE RENTAL FACILITY
IS LOCATED OR FOR THE COUNTY OR MUNICIPAL CORPORATION IN
WHICH THE RENTAL FACILITY IS LOCATED, WHICHEVER IS GREATER,
UNLESS THE LOCAL GOVERNING BODY ELECTS TO USE THE LESSER
AMOUNT;
