SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article - Transportation

16-405.

(a)  If the suspension or revocation of a license would
affect adversely the employment or opportunity for
employment of a licensee, the hearing officer may:

(1)  Decline to order the suspension or
revocation; or

(2)  Cancel or modify the suspension or
revocation.

(b)  For purposes of §16-404 of this subtitle, if a
licensee is required to drive a motor vehicle in the course
of his regular employment:

(1)  [The notice of suspension] SUSPENSION
requires 16 points; and

(2)   [The notice of revocation] REVOCATION
requires 19 points.

(C) THE PROVISIONS OF SUBSECTION (B) OF THIS SECTION
SHALL NOT APPLY TO AN INDIVIDUAL WHO WHOSE CURRENT
ACCUMULATION OF POINTS INCLUDES:

(1) HAS ACCUMULATED LESS THAN 8 POINTS AND
SUBSEQUENTLY RECEIVES ADDITIONAL POINTS RESULTING FROM

CONVICTION FOR A VIOLATION OF §21-902 OF THIS ARTICLE; OR

(2) HAS ACCUMULATED 8 OR MORE POINTS AND

SUSPENSION HAS NOT BEEN IMPOSED PURSUANT TO SUBSECTION (B)
OF THIS SECTION AND SUBSEQUENTLY RECEIVES ADDITIONAL IS
ASSESSED POINTS RESULTING FROM A CONVICTION FOR A VIOLATION
OF § 21-902 OF THIS ARTICLE.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1981.
