Subsection (c) of this section is new language
added to express what presently is only implied
in the law. The reference to "compensation in
accordance with the State budget" is included to
conform to actual practice.
Subsection (d) of this section is also a standard
provision added to this and, where necessary,
corresponding sections in other titles of this
article. It states expressly that which
presently is only implied in the law.
As to subsection (c) of this section, Standard
State Travel Regulations are adopted by the
Department of Personnel with the approval of the
Board of Public Works.
The Commission to Revise the Annotated Code calls
the attention of the General Assembly to the lack
of an express provision establishing the number
of members who constitute a quorum. In the
absence of an express provision, case law
indicates that a majority of the members is a
quorum. See Gemeny v. Prince George's County,
264 Md. 85 (1972),- Zeiler v. Central Ry., 84 Md.
304 (1896); and Heiskell v. Mayor of Baltimore,
65 Md. 125 (1886). If the General Assembly
decides to add an express quorum provision, it
may wish to consider establishing different
quorums for when the dental hygienist member is
or is not eligible to vote.
4-205. MISCELLANEOUS POWERS AND DUTIES.
(A) POWERS.
IN ADDITION TO THE POWERS SET FORTH ELSEWHERE IN THIS
TITLE, THE BOARD MAY ADOPT RULES AND REGULATIONS GOVERNING:
(1) THE ADMINISTRATION OF GENERAL ANESTHESIA BY
A LICENSED DENTIST; AND
(2) THE USE OF A DENTAL ASSISTANT BY A LICENSED
DENTIST IN PERFORMING INTRAORAL PROCEDURES.
(B) DUTIES.
IN ADDITION TO THE DUTIES SET FORTH ELSEWHERE IN THIS
TITLE, THE BOARD SHALL:
(1) KEEP A RECORD OF EACH LICENSE AND EACH
ACTION TAKEN UNDER § 4-314 OF THIS TITLE;
(2) HAVE AN OFFICIAL SEAL; AND
(3) ADOPT RULES, REGULATIONS, AND BYLAWS AS MAY
BE NECESSARY TO CARRY OUT THE PROVISIONS OF THIS TITLE.
