THE SECRETARY SHALL ADOPT RULES AND REGULATIONS TO
CLASSIFY OR CERTIFY SUPERINTENDENTS, OPERATORS, AND
INDUSTRIAL OPERATORS TO PERFORM CERTAIN TASKS IN WATERWORKS,
WASTEWATER WORKS, AND INDUSTRIAL WASTEWATER WORKS.

REVISOR'S NOTE: Subsection (a) of this section is new
language added for clarity and to conform to
comparable "Scope of certification" sections in
other titles of this article.

Subsection (b) of this section is new language
derived without substantive change from Art. 43,
§ 406A(b)(6)(ii).

Subsection (c) of this section is new language
derived without substantive change from the
second sentence of Art. 43, § 406A(c) — as that
sentence relates to classification and
certification of superintendents, operators, and
industrial operators.

The last phrase of present Art. 43, §
406A(b)(6)(ii), which refers to an operator
working in an orderly and safe manner, is deleted
as unnecessary.

20-307. TERM AND RENEWAL OF CERTIFICATIONS.

THE SECRETARY SHALL ADOPT RULES AND REGULATIONS FOR THE
TERM AND RENEWAL OF CERTIFICATIONS.

REVISOR'S NOTE: This section is new language derived
from the intent of present Art. 43, § 406A(c), as
that subsection relates to the Secretary adopting
rules and regulations to carry out the provisions
of this title. This section conforms to current
practice.

For the current rules and regulations as to the
3-year term of a certification and its renewal,
see COMAR § 10.17.06.11C.

20-308. DENIALS, REPRIMANDS, SUSPENSIONS, AND REVOCATIONS
-- GROUNDS AVAILABLE.

(A) DENIALS.

SUBJECT TO THE HEARING PROVISIONS OF § 20-309 OF THIS
SUBTITLE, THE BOARD MAY DENY CERTIFICATION, LIMITED
CERTIFICATION, OR TEMPORARY CERTIFICATION TO ANY APPLICANT,
IF THE APPLICANT:

(1) FRAUDULENTLY OR DECEPTIVELY OBTAINS OR
ATTEMPTS TO OBTAIN A CERTIFICATE, TEMPORARY CERTIFICATE, OR
LIMITED CERTIFICATE FOR THE APPLICANT OR FOR ANOTHER; OR
