In subsection (c)(2) of this section, the stagger
currently used by the Governor for Board
appointments is substituted for the stagger in
present Art. 43, § 406A(e)(2), which would have
the terms of two members expire in 1982, three in
1983, and two in 1985. The attention of the
General Assembly is called to this substitution.
For circumstances under which subsection (c)(4)
of this section applies, see the General
Revisor's Note to this article.
The attention of the General Assembly is called
to the fact that Ch. 702, Acts of 1980,
established a uniform system for consumer
representatives of other health occupation
regulating boards, but did not include this Board
or the State Board of Well Drillers.
The third sentence of present Art. 43, §
406A(e)(2), which states that current Board
members are eligible for reappointment, is
deleted as unnecessary.
20-203. OFFICERS.
(A) CHAIRMAN.
FROM AMONG ITS MEMBERS, THE BOARD ANNUALLY SHALL ELECT
A CHAIRMAN.
(B) BOARD SECRETARY.
THE SECRETARY OF HEALTH AND MENTAL HYGIENE SHALL
DESIGNATE A REPRESENTATIVE OF THE DEPARTMENT AS BOARD
SECRETARY.
(C) ELECTIONS.
THE MANNER OF ELECTION OF OFFICERS SHALL BE AS THE
BOARD DETERMINES.
REVISOR'S NOTE: Subsections (a) and (b) of this section
are new language derived without substantive
change from the fifth sentence, as that sentence
relates to the annual election of a chairman, and
the entire sixth sentence of Art. 43, §
406A(e)(2).
Subsection (c) of this section is standard
language added to this and, where necessary,
corresponding sections of other titles of this
article to clarify the manner of election for
officers of the Board.
In subsection (b) of this section, the reference
to the "Secretary of Health and Mental Hygiene"
is added for clarity and to reflect practice.
