AN ACT concerning
Montgomery County - Bingo

FOR the purpose of transferring certain authority and duties
pertaining to bingo in Montgomery County from one
governmental department of the County to another
department of the County.
BY repealing and reenacting, with amendments,
Article 27 - Crimes and Punishments
Section 255B

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:
Article 27 - Crimes and Punishments
255B.
(a) A bona fide nonprofit fraternal, religious,
patriotic, educational or charitable organization or
charitable corporation or volunteer fire company or
voluntary rescue squad located in Montgomery County that is
qualified under Section 501 of the Internal Revenue Code, as
amended, may operate a game of bingo in Montgomery County
for the benefit of charity or in furtherance of the purpose
of the organization or company. The individual operating the
game must be a resident of the county. All such games shall
be conducted only by the organization, corporation, or
company, and not by any other person, partnership,
corporation, association, organization, or other legal or
business entity which operates the game and retains any
portion of the sales or profits from such bingo games or is
paid any fee or compensation by the organization,
corporation, or company for which the bingo game is being
held.
(b) An organization desiring to conduct a game of
bingo in Montgomery County shall first secure a bingo
license from the county department of [environmental
protection] HEALTH. Application shall be made on forms
provided by the department and shall disclose the following
information with respect to the organization:
