(now § 3-202(g)(2) of this title), as that section relates
to the appointment of replacement Board members, and present
Art. 43, § 501(c) (now § 3-205(a)(l) of this title), as that
subsection relates to impartial regulations. The references
are retained in the revision to avoid substantive change.
However, the Board feels the provisions serve no purpose and
could be repealed safely. Therefore, the General Assembly-
may wish to examine these provisions.

The present law requires that a licensee record a
license with the clerk of the court in the counties in which
the licensee resides and practices, imposes sanctions if the
licensee does not record a license, and authorizes the Board
to remove the name of a licensee from the court records in
some circumstances. Only this title and the title that
relates to Osteopathy contain this recording requirement.
It is an archaic procedure that provides only minimal notice
to the public, and rarely is observed in practice.
Therefore, the Commission to Revise the Annotated Code has
deleted present Art. 43, § 506(a), as that section relates
to the removal of the name of a licensee from the records of
a clerk of a court, § 507, and the last sentence of §
508(a).

Present Art. 43, § 505, which was enacted in 1920 and
provides for the licensing without examination of certain
persons practicing in that year, is deleted as obsolete
since none of the persons affected are still practicing.

The first sentence of present Art. 43, § 514, which
states the duty of certain attorneys to prosecute, is
deleted as unnecessary in light of Art. 10, § 34, which
provides that it is the duty of the State's attorneys to
prosecute for this State.
