(II) BECAME LICENSED IN THE OTHER STATE
AFTER PASSING IN THAT OR ANY OTHER STATE AN EXAMINATION THAT
IS SIMILAR TO THE EXAMINATION FOR WHICH THE APPLICANT IS
SEEKING THE WAIVER.

REVISOR'S NOTE: Subsection (a) of this section is new
language derived without substantive change from
Art. 43, § 512. Its revision is patterned after
the standard language used throughout this
article for provisions that allow or require
waiver of examination requirements.

Also as to subsection (a) of this section, new
language is added to state expressly a provision
that is only implied in present Art. 43, §§
504(b) and 512, i.e., that an individual who is
trained, examined, and licensed in another state
to practice chiropractic with the right to
practice physical therapy may be issued a
comparable license in this State after waiver of
examination. Of course, the Board cannot waive
the physical therapy examination requirement for
an individual who lacks the required training,
examination, and license in that field. The
revised language conforms to the current practice
of the Board.

In subsection (b)(2)(ii) of this section, the
phrase "or any other" state is added to provide
expressly that a chiropractor who passed a
licensing examination in one state, and who then
was waived into a second state, then may be
waived by the Board into Maryland — the third
state — as long as the Board is satisfied that
the licensee completed in some state an
examination similar to that required in this
State. This provision, which is included in most
of the titles of this article and which conforms
with Board practice, allows the Board to give
fair consideration under this section to a
chiropractor who, in the course of the
chiropractor's professional career, has moved
from one state to another before moving to
Maryland to practice here.

title.

3-306. ISSUANCE AND CONTENTS OF LICENSE.

(A) ISSUANCE.
