In subsection (e)(2) of this section, the present
requirement that applicants must pass "an
examination" on physical therapy to qualify for a
license to practice chiropractic with the right
to practice physical therapy is clarified. The
Board considers this "examination" to be the
subsection of the examination that covers
physical therapy. The revised language also
clarifies the meaning of the present reference to
answering correctly 60 percent of the questions
on any "branch" of the examination. In practice,
a branch is considered to be a subject of the
examination, and each subject is covered under a
separate subsection of the examination.
Therefore, an applicant must answer correctly the
required percentage of questions in "each
subsection of the examination".
For additional provisions regarding the practice
of physical therapy by a chiropractor, see §§
3-101(g), 3-301, 3-302(e), and 3-307 of this
title.
In subsection (f) of this section, the word
"authorized" is substituted for "approved" for
clarity.
The provision in present Art. 43, § 504(b) that
relates to chiropractors licensed or in
chiropractic school on June 1, 1949, now appears
in § 3-302(e)(2) of this subtitle.
3-305. WAIVER OF EXAMINATIONS.
(A) IN GENERAL.
SUBJECT TO THE PROVISIONS OF THIS SECTION, THE BOARD
MAY WAIVE ANY APPLICABLE EXAMINATION REQUIREMENT OF THIS
TITLE FOR AN INDIVIDUAL WHO IS LICENSED TO PRACTICE
CHIROPRACTIC OR TO PRACTICE CHIROPRACTIC WITH THE RIGHT TO
PRACTICE PHYSICAL THERAPY IN ANY OTHER STATE.
(B) CONDITIONS.
THE BOARD MAY GRANT A WAIVER UNDER THIS SECTION ONLY IF
THE APPLICANT:
(1) PAYS THE LICENSE FEE REQUIRED BY § 3-306 OF
THIS SUBTITLE; AND
(2) PROVIDES ADEQUATE EVIDENCE THAT THE
APPLICANT:
(I) MEETS THE QUALIFICATIONS OTHERWISE
REQUIRED BY THIS TITLE OR THEIR EQUIVALENT; AND
