FILING OF MAPS AND REGULATIONS IN ACCORDANCE WITH THIS
SUBSECTION SHALL BE DEEMED TO CONSTITUTE NOTICE AT ALL
TIMES, TO THE PUBLIC AND TO ALL PROPERTY OWNERS AFFECTED BY
THIS SUBTITLE, OF THE APPLICABILITY TO THE WETLANDS AREAS
INDICATED ON THE MAPS, REGARDLESS OF OWNERSHIP, OF THE
REQUIREMENT TO OBTAIN A PERMIT BEFORE DREDGING OR FILLING
PRIVATE WETLANDS.

(E) THE PROVISIONS OF THIS TITLE ARE ENFORCEABLE
AGAINST ANY PERSON CHARGED WITH DREDGING OR FILLING PRIVATE
WETLANDS WITHOUT A PERMIT, NOTWITHSTANDING A DEFENSE THAT
PERTINENT WETLANDS MAPS AND REGULATIONS HAD NOT BEEN
PROPERLY FILED AMONG THE LAND RECORDS, IF THE COURT FINDS
THAT THE PERSON CHARGED HAD ACTUAL NOTICE OF THE APPLICABLE
REGULATORY REQUIREMENTS BEFORE HE DREDGED OR FILLED THE
PRIVATE WETLANDS. THIS SUBSECTION SHALL APPLY ONLY TO
DREDGING OR FILLING ACTIVITIES OCCURRING AFTER JULY 1, 1981.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act is
hereby declared to be an emergency measure and necessary for
the immediate preservation of the public health and safety
and having been passed by a yea and nay vote supported by
three-fifths of all the members elected to each of the two
Houses of the General Assembly, the same shall take effect
from the date of its passage. shall take effect July 1,
1981.
