IN ADDITION TO THE DUTIES SET FORTH ELSEWHERE IN THIS
TITLE, THE BOARD SHALL:
(1) ADOPT AN OFFICIAL SEAL;
(2) FILE REPORTS OF ITS ACTIVITIES AS REQUIRED
BY THE SECRETARY; AND
(3) ASSIST IN PROSECUTIONS UNDER THIS TITLE.
REVISOR'S NOTE: This section is new language derived
without substantive change from the last part of
the last sentence of Art. 43, § 499(c), the
first, second, and — except for the second
phrase — the third sentence of § 501(c), and the
second sentence of § 514.
As to subsection (b)(3) of this section, present
Art. 43, § 514 gives the secretary-treasurer of
the Board the duty to assist in prosecutions
under this title. This provision is revised as a
duty of the Board as a whole.
The first clause of the fifth sentence of Art.
43, § 501(c), which relates to keeping Board
rules and regulations on file with the Secretary
of State, is deleted as superseded by the State
Documents Law. See Art. 41, §§ 9 and 256B et
seq. of the Code.
3-206. ESTABLISHMENT OF FEES; DISPOSITION OF FUNDS.
(A) ESTABLISHMENT OF FEES.
EXCEPT FOR THE FEES SPECIFICALLY SET BY THIS TITLE, THE
BOARD, WITH THE APPROVAL OF THE SECRETARY, MAY SET
REASONABLE FEES FOR THE ISSUANCE AND RENEWAL OF LICENSES AND
ITS OTHER SERVICES.
(B) DISPOSITION OF FUNDS.
THE BOARD SHALL PAY ALL FUNDS COLLECTED UNDER THIS
TITLE INTO THE GENERAL FUND OF THIS STATE.
REVISOR'S NOTE: This section is new language derived
without substantive change from the first
sentence of Art. 43, § 508(a), as that sentence
applies to the establishment of fees, and from
Art. 43, § 509(a) and § 512, as that section
relates to the establishment of fees.
Subsection (a) of this section is revised to
clarify the authority of the Board — under its
broad rulemaking powers — to set reasonable fees
for the services for which a fee is not set in
the present law. Although the present law, Art.
43, §§ 508(a) and 512, refers only to the
