      May avoid the accons by Traverse if he Can prove it done at An Other
      place ~
2^dly      The Plf Might have brought detinue or Trover or A Speciall
           Accon upon the Case for damages: but Trespass lyes not for a bare
           Detinue neither Can there be a force in detaining p^rsonalls [illegible] out
           of possion    Macklin p^r D^te.
                And the S^d. Plaint^f. by his Att^ry afd Sayth that the declⁿ afd and the
           Matter therein Contained is Sufficient to Cause the D^ft to Answer
           And thereof prays Judg^t: &c^a.
                And Now here this day to wit the twenty fifth day of August Afd
           the declⁿ pleadings and Allegations on both Sides being by the Co^r
           heard weighed and Maturely Deliberated It is by them Considered
           that the Said Thomas Cook take Nothing by his writt afd but be in
           Mercy for his false Clamour And it is likewise Considered by the
           Court here the Same day and year that the S^d Edw^d. Stevenson
           Recover ag^t. the Said Thomas Cook the Sume of One hundred
           ————— ———— ———— pounds of tobacco by the Court here
           Adjudged him for his Costs and Charges in this behalf laid out
           And Expended according to the form of the Statute &c^a. //

	a^t	\| five hundred ninety three pds of tob^o. the Plf by
	W^m. Deaker	\| R: Macklin his Att^ry prays bayle thereto which was

             granted him Thereupon Comes into Court M^r. Charles Marshall &
             becometh bayle for the S^d. Deaker Sedem Legm and this cause is
             thereupon continued untill next Court //

of John Pemberton	\| :son of Late of Talbot County planter was Sumoned
a^t	\| to answer unto Marg^t. Pemberton Ex^rx of the
Anthony Richardson	\| last will and testament of John Pemberton late of
	Talbot County decd of A plea that he render her

                the Sume of three thousand four hundred twenty Seven pounds of
                tobacco which from her he unjustly detaines —————
      And Whereupon the Said Margret in her afd Capacity by Rich^d. Macklin
      her Att^ry Complaines that whereas At A Court held for Talbot County
      the fifteenth day of August Anno Dmⁱ. 1699 within the Jurisdiction of
      this Court before Robert Gouldesbrough and his fellows Justices of
      the s^d. County Court the S^d John Pemberton In his lifetime by the Consider
      :ration of the S. Justices of Talbot County court recovered Judgment against
