August the 25th. 1702 May avoid the accons by Traverse if he Can prove it done at An Other place ~ 2dly The Plf Might have brought detinue or Trover or A Speciall Accon upon the Case for damages: but Trespass lyes not for a bare Detinue neither Can there be a force in detaining prsonalls [illegible] out of possion Macklin pr Dte. And the Sd. Plaintf. by his Attry afd Sayth that the decln afd and the Matter therein Contained is Sufficient to Cause the Dft to Answer And thereof prays Judgt: &ca. And Now here this day to wit the twenty fifth day of August Afd the decln pleadings and Allegations on both Sides being by the Cor heard weighed and Maturely Deliberated It is by them Considered that the Said Thomas Cook take Nothing by his writt afd but be in Mercy for his false Clamour And it is likewise Considered by the Court here the Same day and year that the Sd Edwd.
