                                         Aprill Court 1702
      time &ca. At the Speciall Instance and request of the Said Testator and for ye:
      proper use and Service of him the said Testator he the Said Michaell
      did Severall, Severall, &ca. which is incoherent Nonsence that the Testr.
      Should request himself to do unto himself diverse Services to his own use ~

3ly—    The Plaintif by his decln And Account Sets forth that he sets f had
        delivered to the Testator diverse Sums of Mony but doth not Alledge
        that he either Sold or Lent the Said Testatr. the Said Sums of mony
        So that by Any things Alleadged the Mony might be given or
        but a quid pro quo for Some other Consideration recd by the sd plaintf.
4ly—       The Seventh Article of his Account is for eight peices of 8 &
        And ½ a Crown delivered for merchant which ^is So insensible an
        Article that the defendt. knows not what is Ment by it ~
5ly—       Diverse of the Articles are for Attry fees (in the sd. Acco.) in Talbot
        County And the Plaintiff in his decln doth not Set forth or Alledge
        that he was ever Admitted And Sworn An Attry in Talbot County Cort
6ly—    The act of Limitation lyes against the Two first yeares in
        the Plaintifs account Menconed ~
                And the Sd Plaintf. in his prper prson Sayth that the decln and
        Account are Sufficient to Cause the defts. to Answer thereunto & thereof prays
        Judgt. as afd ~
                And Now here this day to wit the Same day and year afd
        The Decln and Demurr. And Allegations thereupon being by
        the Justices weighed and Maturely deliberated It is by them
        Considered that the Sd. Michael Earle take Nothing by his writ
        Afd but be in Mercy for his false Clamour and that the Said
        Henry Hynson & Uxr. Go thereof without day And it is likewise
        Considered by the Sd Justices that the Said Henry Hynson & Uxr.
        Exrs abovesaid Recover against the Said Michaell Earle the Sum
        of One hundred and Sixty and Six —— pounds of tobacco for their
        Costs and Charges in this behalf layd out and Expended according
        to the form of the Statute ~ ~
