        Lloyd of A plea of Trespass upon the Case for the Sume of one
        thousand two hundred ninety four pounds of tobo. part of a debt
        of two thousand three hundred pounds of tobacco As by the decln
                                                   by R Macklin their Attry
        And Account filed in this Court ^ May at large appeare ~
      And the Said Defendt. by Michael Earle his Attry Comes and Defends
      the force and Injury When &ca. and prays leave to imprle here
      :unto untill next Court and he hath it ye. Same day is fiven the
      Plaintf. also. At which Said next Court Being the twenty fourth
      day of March the parties Appeared but for as much as all
      proceedings of this Court were Contd. untill the first tuesday
      of Aprill next by virtue of An Act of Assembly in yt. case prvided
      this Cause was Contd. Accordingly ~
                At Which Said first Tuesday in Aprill being the
      Seventh day of the Same Month Comes the Sd prties by their Attry
      Afd and the Sd Defendts. by their Attrys afd further defends ye.
      force and Injury when &ca. And for plea Sayth yt. the plf his
      Accon afd against the Sd Defendts. by Law ought not to have
      And Maintaine for that the defts Sayth that the Said Sume of twelve
      hundred pounds Ninty four pounds of tobacco being the Alledged
      ballance in the Account of the plaintf annexed to his decln ==
      was not demanded before Accon brought, and of this they in
      their Said Capacity put themselves upon the Court    Earle pr Dce
        And the plf in like Manner    Macklin pr qr
      And Now here the Seventh day of Aprill Anno Dom 1702 afd
      The Pleadings and Allegations on both Sides being by The Justices
      heard and fully understood It is by them Considered the Same
      day and year that the Sd. Philln Lloyd recover agt. the Said Charles
      Marshall & Uxr. Exrs as afd As well the Sume of twelve hundred
      ninety four pounds of tobacco the debt afd as the Sume
      of three hundred and thirty nine    ~    ~    pounds of tobo.
