6) certain Thomas Man recovered Judgt. agt. Robert Smith Esqr. for ye. Sume of one thousand four hundred twenty Eight pounds of tobacco and an half pound And forty Seven pounds three Shillings and Six pence Sterg. from which Sd Judgt. The sd. Robt. Smith Esqr. appealed (as by the record of this court may Appeare) to the next provll. Court, Where the Said Smith not prosecuting his appeale with Effect, his Majesties Writt de procedendo Issued to the Justices of this Court of Kent in these words Vizt. ~~~~ William the third by the grace of God of England Scotland ffrance and Ireland King Defender of the fayth &ca. To Our Justices of our County Court of Kent Greeting Whereas Robert Smith Esqr. latly appealed from a Judgt. before you by Thomas Mann obtained agt. him Wherein the Said Thomas Mann recovered agt. Robert Smith Esqr. as well The Sume of One thousand four hundred twenty Eight pounds and An half pound of tobacco and forty Seven pounds three Shillings & Six pence Sterg. debt As Also the Sume of Seven hundred thirty and Seven pounds of tobacco Costs of Suit from which Judgt. the Said Robert Smith appealed to our Justices of our Provinciall Court and gave Security to prosecute The Same wth. Effect And for that the Said Robert Smith hath not prosecuted the Same with Effect According to An Act of Assembly in that Case made and provided Wee do therefore Command you that at the next County Court to be held for yr. County you proceed to affirm yr. Judgt. afd And grant Execution thereupon as if the Said had Not been appealed from Wittnesse Thomas Smithson Esqr. Chief Justice of our Said Court ye. Eighteenth day of October in ye. 13th. year of our Reign &ca. Annoq Domi. 1701 ~~ Att which Said next Court held for ye. Said County of Kent to wit ye twenty Seventh day of Janry Anno Domi 170½ The Writ afd being produced and read to the Justices of the Sd County Court of Kent It is by Them Considered The day and year last Mentioned That The Said Judgt. appealed from by The Said Smith be affirmed agt. him And be as Valid As if it had never been appealed from And That the Said Thomas Mann may have Execution as well for the debt and costs by the Afd Judgt. obtained As Also the Sume of Additionall costs accruing upon the de procedendo and affirmation of ye.
