Sutton Quiney’s Admr    | County decd was Summoned to Answer


      unto Wm. Frisby of a plea that he rendr.
        him the full and Just Sume of twelve hundred forty and
        Eight pounds of good Sound bright tobacco in Casq clear
        of ground leaves and All other Trash which from him he
        unjustly detaines .
           Whereupon the Said William by Richard Macklin his
        Attorney Says that whereas the Said Sutton Quiney in his
        life time to wit the thirtyeth day of March Anno Domi 1697
        At Kent County within the Jurisdiction of this Court by
        his Certaine bill or writing Obligatory Sealed with
        his Seale as his act and deed delivered and herein Court
        brought whose date is the afd Day and year did bind
        himself his heires Exrs and Admrs to pay of Cause to
        be paid unto the Said Wm. his heires Exrs Admrs. or Assgs
        (on demand) the afd Sume of 1248lb tobacco qualifyed as
        afd At his the Said Sutton’s Dwelling plantacon
        in Cecill County Yet Notwithstanding the Said Sutton in
        his life time the afd Sume of twelve hundred forty eight
        pounds of tobacco According to the tenr. of the afd bill
        Obligatory unto the Said Wm. did not pay neither
        did Joyce Quiney Admrx of the afd Sutton Quiney when Sole
        pay the afd 1248lb tobo. Nor Neither did their Said Joyce and
        the Said John Toaes after their Intermarriage pay the
        Same 1248lb tobacco Nor neither hath the Said John Toaes
        after the death of the Said Joyce paid the Same 1248lb tobo
        Altho’ often demanded but the Same to the Said Wm. to
        pay the Said Jno Toaes Still doth deny and unjustly detaine
        to the Damage of the Said Wm. Frisby of 2400lb tobacco
        And thereupon he brings this Suit
                     Macklin pr qr. pleges &ca. Jno. Doe. R: Roe
        And the Said Defendt. by Michael Earle his Attry Comes
        and defends the force and Injury when &ca. And prays leave
        to Imparle hereunto untill next Court, and he hath it
        the Same day is given the plaintf. Also ~
