                                         Aprill Court 1702
        Whereof the Said Samuell upon himself Assumed And unto the
        Said Edward faithfully promised that he the Said Samuel When
        thereunto afterwards required the Said Sume of 567&189lb tobacco
        unto the Said Edward he would well and truely pay Yet notwithstand
        :ing the Said Samuel his Assumption and promise afd Not minding
        or regarding but plotting And fraudulently intending him the
        Said Edward of the afd Sume of 567½ Tobacco wrong fully and
        Subtilly to deceive And defraud the afd 567½lb tobo. according to
        his afd Assumtion and promise unto the Said Edward altho’
        often Demanded he hath not paid but the Same to him to pay
        hath denyed And As yet doth deny the Same to him the Sd.
        Edward to pay to the damage of the Said Edward ffry 1067½lb
        tobacco and thereupon he brings this Suit

        And the Said Samuel by Michll. Earle his Attry Comes and
        Defends the force and Injury when &ca. And prays leave to
        Imprle hereunto untill next Court which is granted him the Same
        Day is given the Plaintf. also ~
           At which Said next Cort to wit the 24th. day of March Anno
        170½ the Prties Appeared: but for as much as all proceedings
        In the Said Cort were Continued by virtue of An Act of Assembly
        Entituled An Act for the relief of Kent And Calvert Counties
        untill the first Tuesday of Aprill next ye. Cause was Accordingly
        Continued.
                     On which Said Next Tuesday to wit the Seventh day
        of Aprill here Comes the Said Parties by their Attrys afd
        And the Said Defendt: by his Attry further defends the
        force and Injury when &ca. And Sayth that for the Many
        insufficiencys and uncertainties in the plaintifs decln and
        the Account thereunto Annexed he the Said Defendt. is not
        bound nor by the Law of the Land is he obliged to Answer
        thereunto all which he is ready to Averr therefore for want
        of a good declaration and A Certaine and Lawfull Account
        he the Said Defendt. prays Judgt. if Accon &ca. Earle pr Defce
Reasons in Demurr. The plaintif in his declaration Chargeth the defendt:
        with the Sume of five hundred Sixty Seven And one half pds
        of Tobacco but what the plaintif meaneth by the five hundred
        Sixty Seven, wheather hundred weights ½ hundreds ^or quarters ye.
