	Wroth of a plea y^t he render unto him y^e full & Just Sum^e of
	twelve thousand Six hundred pounds of good Sound merchantable
	leafe tobacco & Cask to Containe y^e Same w^ch from him he un
	justlÿ Detaine as appears more att large bÿ a Declaⁿ filed in

        this Court bÿ Richard Macklin Att^rÿ fo^r y^e S^d pltf
           And the S^d Def^t bÿ Michael Earle his att^rÿ Comes and Defends the force
      and Injurÿ when &c^a and praÿed leave to Imp^rle thereunto unto next Court
      w^ch was Granted him y^e Same Daÿ was Given the pltf allsoe att w^ch S^d —
      next Court being y^e 27^th Daÿ of June anno Dñi 1704 both p^rties appear’d
      and this accõn was Continued untill Next Court, att w^ch Sd Next Court to witt
      this two and twentÿeth Daÿ of Aug^t anno Dñi 1704 comes the S^d p^rties bÿ ~
      their att^rÿs afs^d, And y^e S^d pltf praÿs y^t the S^d Def^t maÿ answer to his De:
S= claⁿ afs^d, And y^e S^d Def^t Comes here in aopen Court in his afs^d Capacitie &
      and Saÿeth y^t he Cannot Gainsaÿ y^e pltf in his accõn afs^d Soe as afs^d brought
      and is therefore willing y^t Judg^t be Int^r ag^t in S^d Capacitie fo^r y^e Debt ~
      afs^d &c^a and y^e S^d pltf comes into Court & releases y^e penalltÿ of y^e S^d bond: & praÿs
                                    y^t y^e Judg^t for y^e residue being 6300^ls tob^o & Cost of Suit
           Which being bÿ y^e Court heard and fullÿ understood It is bÿ them ~
      Considered here this 22^th Daÿ of Aug^t anno Dñi 1704 That y^e S^d pltf recover
      against y^e S^d Def^t in his S^d Capacitie as well y^e Sum^e of ~~twelve~~^Six thousand

      Three hundred pounds of tob^o ^ Debt afs^d as y^e Sum^e of two hundred
      thirtÿ and nine pounds of tobacco Cost of Suit and y^e Def^t in mercÿ &c^a

        hundred and Eight pounds of good Sound merchantable leafe tobacco Clear
        of all manner of Ground leaves and trash bright in well Seasoned Cask ~
        to Containe y^e Same which from him he unjustlÿ Detaines as bÿ a Declaⁿ
        and bond filed in this Court bÿ Richard Macklin y^e pltfs att^rÿ y^e Same
        appears
           And y^e afs^d Giles bond in his afs^d Capacitie bÿ Michael Earle his att^rÿ
        comes & Defends y^e force and Injurÿ when &c^a and Craves oÿer of y^e afs^d
