Comãnd was Given to ye Sherf of Kent Countÿ the first Daÿ of Aprill 1704 to take Edward Jessopp of Kent Countÿ Carpenter if to be found in his bailewicke and him Safe Keep &ca to answer unto Michael Earle att next County Court to be held for Sd Countÿ in a plea of trespass upon the Case att which Said next Court ye Sd Sherf Sherf made retn of ye writt Endorsed Cepi Corpus pr me Jn Hns Whereupon ye Sd Deft appear’d & bÿ Christopher Phillipson his attrÿSherf |wth leave) Imprled untill next Court att which Sd next Court to witt this 22th Daÿ of Augt anno Dñi 1703 Comes as well ye Sd Deft bÿ his attrÿ afsd as the Sd pltf bÿ Michael Earle his attrÿ who Declares as falloweth~ Kent Countÿ | Ss) in Marÿland | Edward Jessopp of Sd Countÿ Carpenter Stands attached to answer unto Michael Earle one of ye attrÿs of Sd Court according to ye privi= And whereupon ye Sd Michael in his proper prson in prosecution of ye accon afsd cõmplains & Saÿeth yt whereas ye Sd Edward on ye 20th Daÿ of Septbr ano Dñi 1698 [?] in Sd Countÿ wthin ye Jurisdiction of this Court bÿ his Certaine note or Script Signed wth ye propr hand of ye Sd Edward as his act & Deed Delivered & herein Court brought whose Date is ye Same Daÿ & year Did obliedge himselfe his heires &ca to paÿ ~ unto ye Sd Michael Earle or ordr. ye Sume of one thousand pounds of tobo in Cask & twentÿ four Shilling’s Six pence Curãnt moneÿ as bÿ ye Same note or Script here in Court brought ye Same appears In Condrion thereof ye Sd Edward upon himselfe assumed & unto ye Sd Michael faithfullÿ prmissed yt he ye Sd Edward ye afsd Sume of 1000 paÿ when thereunto afterwards required yett nevertheless ye Sd Edward ~ ye afsd Sume of 1000 unto the Sd Michael he hath not paid allthough often Demanded but ye Same to paÿ he hath Denÿed & refused and Still Doth Denÿ & refuse & unjustlÿ Detaine to ye Damãge of ye Sd Michael 2000 And thereupon he bring’s this Suit
comes & Defends ye force & Enjurÿ when &ca and Saÿeth that he wth ye Debt afsd Debt afsd bÿ retn of ye writeing afsd ought not to be Charged because he Saÿeth yt that writeing is not his Deed and of this he putts himselfe upon ye Countrÿ Phillipson pr Defce And ye pltf in like manr Earle prpria prsona Thereupon Comãnd is Given to ye Sherf of Kent Countÿ yt he Imediatelÿ Cause to Come here twelve &ca bÿ whome &ca who neither &ca to recognize because as well &ca and ye Sd Sherf Saÿeth yt he hath here readÿ twelve &ca to will William Swettnam Daniel Wild, William Austin, Edward Carrill Renotus Smith Jon Swetnam Thomas Bruff Geo: Smith Wm.
