      Comãnd was Given to y^e Sher^f of Kent Countÿ the first Daÿ of Aprill 1704 to
      take Edward Jessopp of Kent Countÿ Carpenter if to be found in his bailewicke
      and him Safe Keep &c^a to answer unto Michael Earle att next County Court to
      be held for S^d Countÿ in a plea of trespass upon the Case att which Said next
      Court y^e S^d Sher^f Sher^f made retⁿ of y^e writt Endorsed Cepi Corpus p^r me Jⁿ Hns
   Whereupon y^e S^d Def^t appear’d & bÿ Christopher Phillipson his att^rÿ^{Sher^f} |w^th
   le^ave) Imp^rled untill next Court att which S^d next Court to witt this 22^th
   Daÿ of Aug^t anno Dñi 1703 Comes as well y^e S^d Def^t bÿ his att^rÿ afs^d as
   the S^d pltf bÿ Michael Earle his att^rÿ who Declares as falloweth~

                        unto Michael Earle one of y^e att^rÿs of S^d Court according to y^e privi=
      And whereupon y^e S^d Michael in his proper p^rson in prosecution of y^e accon afs^d
      cõmplains & Saÿeth y^t whereas y^e S^d Edward on y^e 20^th Daÿ of Septbr an^o Dñi 1698 [?]
      in S^d Countÿ w^thin y^e Jurisdiction of this Court bÿ his Certaine note or Script Signed
      w^th y^e prop^r hand of y^e S^d Edward as his act & Deed Delivered & herein Court brought
      whose Date is y^e Same Daÿ & year Did obliedge himselfe his heires &c^a to paÿ ~
      unto y^e S^d Michael Earle or ord^r. y^e Sum^e of one thousand pounds of tob^o in Cask
      & twentÿ four Shilling’s Six pence Curãnt moneÿ as bÿ y^e Same note or Script
      here in Court brought y^e Same appears In Condrion thereof y^e S^d Edward —
      upon himselfe assumed & unto y^e S^d Michael faithfullÿ p^rmissed y^t he y^e S^d
      Edward y^e afs^d Sum^e of 1000^ls of tob^o & 24^s:6^d unto y^e S^d Michael he wold well & truly
      paÿ when thereunto afterwards required yett nevertheless y^e S^d Edward ~
      y^e afs^d Sum^e of 1000^ls of tob^o & 24^s:6^d according to his afs^d promiss & assumption
      unto the S^d Michael he hath not paid allthough often Demanded but y^e Same
      to paÿ he hath Denÿed & refused and Still Doth Denÿ & refuse & unjustlÿ
      Detaine to y^e Damãge of y^e S^d Michael 2000^ls of tob^o & 2^ls of like moneÿ
      And thereupon he bring’s this Suit

                                    And the afs^d Def^t bÿ Christopher Phillipson his att^rÿ-
                                    comes & Defends y^e force & Enjurÿ when &c^a and Saÿeth
      that he w^th y^e Debt afs^d Debt afs^d bÿ retⁿ of y^e writeing afs^d ought not to be Charged —
      because he Saÿeth y^t that writeing is not his Deed and of this he putts himselfe
      upon y^e Countrÿ                                          Phillipson p^r Defc^e
                                 And y^e pltf in like man^r Earle p^rp^ria p^rsona
      Thereupon Comãnd is Given to y^e Sher^f of Kent Countÿ y^t he Imediatelÿ
      Cause to Come here twelve &c^a bÿ whome &c^a who neither &c^a to recognize
      because as well &c^a and y^e S^d Sher^f Saÿeth y^t he hath here readÿ twelve
      &c^a to will William Swettnam Daniel Wild, William Austin, Edward Carrill
      Renotus Smith Joⁿ Swetnam Thomas Bruff Geo: Smith W^m. Sigleÿ Joⁿ Moore
      Thomas Rooth Matthew Collear Who being being Duelÿ Elected trÿed
      and Sworn to Saÿ y^e truth in y^e p^rmisses Doe Saÿ upon their oathes we of
      of y^e Jurÿ Doe find fo^r y^e [Pltf &] Doe assess in Damages 1000^ls of tob^o
      & twentÿ four Shillings Curr^t moneÿ as allsoe Cost of Suit ~
