      of twelve hundred pounds of tob^o y^e Debt afs^d as y^e Sum^e of two hundred
      Seaventÿ & three pounds of tob^o Cost of Suit & y^e Def^t in mercÿ &c^a ——

ag^t	\| 1704 to take y^e S^d Jessup if to be found in his Bailewicke and him
Edward Jessup –	\| Safe keep Soe y^t he maÿ have his bodÿ before y^e Justices
	\| (Imediatelÿ) here, to answer unto James Keach in a plea of

        trespass upon y^e Case, and y^e Said Sher^f makes an Immediate retⁿ of his S^d
        p^rcept Endorsed as fallaweth viz^t Cepi Corps p^r me Jn^o Hawkins Sher^f
        Whereupon y^e S^d ~~Sher^f~~ Def^t appears and bÿ Xphr Phillipson his —
        att^rÿ ~~praÿs~~^{w^th} leave u Imp^rles untill next Court att w^ch S^d next
        Court to witt the 27^th Daÿ of June anno Dñi 1704 this Cause was —
        Continued untill next Court att w^ch S^d next Court to witt this 22^th Daÿ of
        Aug^t 1704 Comes as well y^e S^d Def^t bÿ his att^rÿ afs^d as y^e S^d pltf bÿ —
        Michael Earle his att^rÿ who Declares as falloweth viz^t

in Marÿland	\| Edward Jessupp afs^d Countÿ Carpenter Stands attached to answ^r.
	unto James Keech of y^e afs^d Province Merchant of a plea of trespass
	upon y^e Case

        and whereupon y^e S^d James bÿ Michael Earle his att^rÿ Complaines & Saÿeth y^t
        Whereas on y^e 19^th Daÿ of June 1702 at S^t. Marÿ’s County in Said Province —
        w^thin y^e Jurisdiction of this Court att y^e Speciall Instance & request of y^e S^d —
        Edward he y^e Sd James Delivered unto him y^e S^d Edward Divers goods warres
        and merchantdizes amõunting in y^e whole to y^e Sum^e of twelve hundred & Seaventy
        pds of of tobacco as bÿ an acc^t to this Decloⁿ Annexed and here in Court brought
        y^e Same appears, In Condraiõn thereof the S^d Edward upon himselfe assumed
        and unto y^e S^d James faithfull&255 p^rmissed y^t he y^e S^d Edward y^e S^d Sum^e of 1720^ls
        of tob^o unto y^e afs^d James he wo’ld well and truelÿ paÿ When thereunto
        afterwards required yett nevertheless y^e S^d Edward his p^rmisse and assumption
        before made not minding nor regarding but Shifting & fraudulentlÿ
        Contriveing him y^e Sd James in this behalfe to Deceive & Defraud y^e S^d Sum^e
        of 1270^ls of tob^o unto y^e S^d James he hath not paid although often Deman:
      =ded but y^e Same to paÿ he hath Denÿed & refused & Still Doth Denÿ &
        refuse and unjustlÿ Detaine to y^e Damãge of y^e S^d James 2400 of tob^o &
        thereupon he brings this Suit       Earle p^r q^r: Pledges &c^a Joⁿ. Doe
