Kent Ss/ James Dunhaw of Kent Countÿ pltr was Sumõned to answr: unto James Wroth who as well for our Soveraigne Ladÿ ye Queen as for himself in this behalfe prsecuteth of a plea yt he rendr them ye Sume of five hundred pounds of tobo wch: to them he oweth & unjustlÿ Detaineth : and whereupon ye Sd James Wroth who as well for our Sd Ladÿ ye Queen as for himselfe in this behalf prsecuteth bÿ Richard Macklin his Attrÿ Saÿeth yt whereas a Certaine act of assemblÿ of this Province of Marÿland made [att?] att a ssion of assemblÿ beguñ & held att ye Towne & Port of Annapolis ye 27th Daÿ of June & Ended ye 22th daÿ of July in ye Eleventh yearof ye Reigne of our Late Soveraigne Lord William ye third &ca of England &ca annoq Dñi 1699 his Excllcÿ Natthaniel Blackston Esqr: being Govr: &ca amongst other things it was Enãcted as falloweth |vizt) That if anÿ person or prsons whatsoever Shall: wittinglÿ or willinglÿ Detaine anÿ Servant or Servtt: un: lawfullÿ abscenting him her or themselves from ye Service of his her or their master, mistr’s or Dame Shall be fined five hundred pounds of tobo for Everÿ night or four & twentÿ foure hours yt Such person or persons Shall give Entertain mt: to Such Servt: or Servts: unlawfullÿ abscenting him her or themselves as afsd yett nevertheless The Sd James Dunahaw the act of assemblÿ afsd caring for nor ye penalltÿ in the Same Contained not fearing afterwards |That is to Saÿ) These third & fourth Daÿs of Aprill Anno Dñ 1703 att Kent Countÿ wthin ye Jurisdiction of this Court Did wittinglÿ & willinglÿ Detaine a Certaine Samuel Millson Then Servt to ye Sd James Wroth and ye Sd Samll: Millson then & there bÿ the Space of four & twentÿ hours Did Entertaine bÿ wch accõn accrews to ye Sd James Wroth as well on ye prte & behalfe our Sd Ladÿ ye Queen as of himselfe to have & require of ye Sd James Dunahaw ye afsd Sume of five hundred pds of tobo, yett nevertheless ye Sd James Dunahaw ye afsd Sume of 500 of tobo unto our Sd Ladÿ ye Queen & ye Sd James Wroth who as well &ca altho’ often required hath not paid but ye Same to paÿ hath Denÿed & refused & Still Doth Denÿ & refuse & unjustlÿ Detaine to ye Damãge our Sd Ladÿ ye Queen & ye Sd James Wroth who as well &ca 1000 produceth this Suit Macklin pr qr: Pledges &ca John Doe Rid Roe To wch Declan ye Sd Deft mÿ Sd Attr Comes & Defends ye force & Enjurÿ when &ca & for plea Saÿeth Not Guiltÿ pr patriam Earle pr Deft And ye pltf allsoe Macklin pr qr Whereupon Comãnd was Given to ye Sherf of Kent Countÿ yt he Ime= =diatelÿ Cause to Come here twelve &ca bÿ whome &ca who nither &ca to recognize because as well &ca who makes return of his Sd prcept |
