      Anno Dñi 17034 And now here this prsent Court ye plead and allegations
      being read, |& ye Demr Joyned,(before ye Justices here prsent) all which being
      Duelÿ Considered (bÿ ye Sd Justics ) & maturelÿ Deliberated;
           It is therefore Considered here bÿ ye Court this two & twentÿeth Daÿ
      of Januarÿ anno Dñi 17034 yt ye afsd plea of ye afsd Deft is not good
      in Law, nor noe waÿs allowable to Debarr the Sd pltf from his accõn
      afsd Soe as afsd brought; It is likwise Considered bÿ ye Sd Court here ye Same
      Daÿ & year yt ye Sd pltf recover agt ye Sd Deft as well ye Sume of one ›
      thousand one hundred and Seaventÿ pounds of tobacco the Debt afsd as ye
      Sume of two hundred Sixtÿ & Nine [?] pounds of tobacco Cost of Suit and the
      Deft in Mercÿ &ca

      John Hawkins Senr |    Comãnd was Given to ye Sherf of Kent Countÿ the 27th
             at |    Daÿ of Janrÿ Anno Dñi 1702 to take John Loÿde if
      John Loyde — — |    to be found in his bailewick & him Safe keep, to have

     his bodÿ before ye Justices of Kent Countÿ Court to be

     att next Court for Sd Countÿ, which was to be on ye

     three & twentieth Daÿ of March then next fallowing
       And when ye Daÿ of ye return of writt came, vizt ye 23th Daÿ of March afsd
      the Sherf made return hereof Cepi Corps pr me John Hawkins Sherf
           Whereupon ye Sd Deft appears. and praÿ bÿ Ricd Macklin his attrÿ praÿs
      leave to Imparle hereunto untill next Court which is Granted him ye Same
      is Given ~ the pltf allsoe, att wch Sd next Court this accõn was Conti=
     :nued untill next & Soe it was Continued from Court to Court untill this
      prsent Court, att wch Sd prsent Court Comes as well ye Sd Deft bÿ his attrÿ
      afsd, as ye Sd pltf bÿ Richa Michael Earle his attrÿ who Declares as —
      falloweth vizt
     Kent Ss/    John Loÿde of ye afsd Countÿ Stands Attached to Answer unto John Haw:
                      :kins Senr late of ye Same Countÿ Merchant in a plea yt he rendr: to him the-
                       full & Just Sume of Eight hundred pounds of good Sound Merchantable
                       Tobacco which to him he oweth and from him unjustlÿ Detaineth
      And whereupon ye Sd Jon: bÿ Michael Earle his Attrÿ Complaineth & Saÿeth that ye Sd Jon
      to witt ye 7 8 Daÿ of 7ber Anno Dñ 1691 bÿ his Certain bill in writeing obligatorÿ
      Sealed wth his Seale as his act & Deed Delivered and here in Court brought whose Date
      is ye Daÿ & year afsd Did bind himselfe his heires Exrs: admrs to paÿ or Cause to be
      paid unto ye Sd John Hawkins Merchant ye full & Just quantÿtie of Eight —
      hundred pounds of good Sound Merchantable Tobacco in Cask to be paid to ye Said
      John Hawkins his heires Exrs: admrs: or assignes upon ye tenth Daÿ of 8ber next
      Ensueing the Date of ye Sd bill in Some Convenient place in Chester River
      Notwthstanding ye Sd John Did not paÿ ye afsd Eight hundred pounds of tobacco
      according to ye tenr of ye Sd bill nor att anÿtime Since allthough often De Dem=
     =manded ye Same to paÿ hath Denÿed & refused and Still Doth Denÿ & refuse
      to the Damãge of him the Sd John Hawkins 1600ls of like tobacco & thereupon
       he brings this Suit Earle pr qr Pledges &ca John Doe Richd Roe
